In September 1994, Connie and Carl Scott of Blair, Nebraska found out that their fifteen-year-old daughter was pregnant. They supported her decision to have an abortion. But the girlÆs boyfriend and his parents barged into their home one evening, allegedly attacking them and calling them "baby killers."
Police arrived and arrested the boyfriend. But one officer allegedly attempted to give the girl anti-abortion literature. Several hours later, she was taken into "protective custody" on the basis of a "To Whom It May Concern" letter from a doctor who had not examined the minor. The doctor claimed that the proposed abortion would endanger the minor.
The girl was placed in foster care for 36 hours. A judge allowed her to be returned to her parents custody "on the condition that no abortion shall be performed on the subject's unborn child without further order of the Court." In December 1994, she gave birth.
In this complaint, the Scotts sue the county, various law enforcement officials and the boyfriendÆs family. The counts include trespass, illegal search and seizure, invasion of privacy and interference with the right to reproductive choice.
